So long as u dont keep the *item which hurt burgular* <i>for</i> defense purposes then u can claim being scared and acting without thought or whatever.<br><br>I could stab someone who broke into my house and not get sued. All I need to do is keep an apple and a knife by the side of my bed, say I slice it to eat it but I fell asleep and didnt clear it up. Then, in the heat of the moment, cos I was scared for my life, I just grabbed something to defend myself with.<br><br>Even if I didnt get off on a normal trial I should get off on appeal with the right legal representation.

Uhh - don't think that applies to burgulary (at least not in this country). But I know for a fact it applies for being attacked. If you don't have the item on you as a weapon, it's legal to use it in self defence, provided you don't use excessive force.<br><br>...But, you wouldn't get sued for that. You'd be charged with assault/gbh, and then it would be up to you to prove you were acting in self defence. Which isn't the easiest of things to do in a court of law, or so I hear.

You wake up, they're in your room, sneaking around, its dark, you're alone.<br>They're most probably a strong young male, with maybe an assault charge form the past (OK this is <b>very</b> sweeping). I think that if they've entered your house illegally, they've meant to do you harm (albeit financial) and they don't run as soon as they see you then I reckon you've got a reasonable case for self defense.

Mm... Maybe. But I wouldn't want to use anything other than a blunt object on them. There's been some stupider lawsuits in the past.<br><br>of course, a guy breaks into a house, gets confronted by a big alsation (specifically a German Shepperd. Big fwuffy thing.). So he goes into the fridge, makes himself breakfast, and gives the dog some. Police were, shall we say, somewhat amazed.<br><br>That's a true story about a breakin down the road from where we lived about three or four years before I was born. When the guy broke into our, well, my parents house, my sister desturbed the guy walking to the bathroom and he fled, which as I recall, gave the cops the clue that lead to his arrest.

Please keep in mind that anyone can sue anyone for whatever reason; it doesn't mean they'll win the case.

lol my mum used to live in birmingham (read: rough as hell) and ended up nearly stabbing my dad. The apple is gone, cos u ate it but u didnt clear the plate away - and the fruit will be good for you!
